Arnold murder trial: Andrew Dosiuk had gunshot wounds to chest and abdomen

Gunshot injuries to the chest and abdomen caused the death of Arnold man Andrew Dosiuk, a murder trial heard.

Jurors trying the case of three men accused of his murder were told Mr Dosiuk was shot three times and would have died within minutes.

Pathologist Professor Guy Rutty, who carried out a post-mortem, described in his evidence at Nottingham Crown Court the path of the gunshots fired into Mr Dosiuk in his bedroom in November last year.

Mr Dosiuk, of Laneham Avenue, had been due to go on trial at the court on drug supply charges the same month he was killed.

He was allegedly executed as someone stood over him in his bed in a "contract killing", say prosecutors.

Three men are accused of his murder – Michael Furniss, 50, of no fixed address; Stuart Hall, 23, of Seely Avenue, Calverton; and James Stacey, 30, of Forest Road, Mansfield, who all deny the charge.

Mechanic Stacey was allegedly being put under pressure by Mr Dosiuk to repay a drug debt, estimated to be £7,000, at the time.

Furniss, who had been working as a HGV driver, was recruited as the gunman, say prosecutors. Hall was effectively the middle man between Furniss and Stacey, who were all members of the same Mansfield gym.

After leaving work, Furniss collected Hall and went to Arnold where they were both involved in the murder, prosecutors claim.

One or both of them went into the house and shot him three times, then let themselves out with a key.

Mr Dosiuk was found by police dead on his bedroom floor after friends tried during the day to contact him but without success, the court has heard.

Prof Rutty had concluded the cause of death was gunshot injuries to his chest and abdomen.

He said one of the bullets was recovered from Mr Dosiuk's abdomen, while the remainder had passed through his body.

One of the shots had been at the back of the left shoulder area, where there was an entrance wound, and injured his left chest cavity and upper part of his left lung.

Another shot went into Mr Dosiuk's chest, when his body was not in a straight position, explained Prof Rutty, and injured his ribs, lung, liver, stomach.

A third shot penetrated his right chest cavity and injured his diaphragm, liver, lung and heart.

On two occasions the entrance wound indicated the firearm had been held close to his body but a third appeared to have been fired from a further distance.

There was no evidence Mr Dosiuk had tried to defend himself in any way, said Prof Rutty on October 20.

He had attempted to estimate the time of death by testing for potassium levels during the post-mortem.

Based on the results, Prosecutor David Herbert QC asked: "Is it then in keeping with death having occurred somewhere between 7am and 8am on November 11?"

Prof Rutty replied: "Taking it as an estimate and bearing in mind you cannot be precise, it may have occurred at that time, yes."
